Important: By accessing or using the Gurughar360.ca platform, you agree to be bound by these Terms & Conditions. Please read them carefully before using the service. If you do not agree, do not use the platform.

1. Definitions

"Platform" means the Gurughar Bookings web application operated at Gurughar360.ca and all associated services.
"Gurughar360.ca", "we", "us", or "the Company" means the operators of the Platform, including its directors, shareholders, officers, and employees.
"Organization" or "Institute" means a Gurudwara, Sikh Society, or similar community body registered on the Platform.
"User" means any individual who accesses the Platform, whether as a member of an Organization or as a visitor.
"Service" means the booking management, event scheduling, and related administrative features provided through the Platform.

2. Acceptance of Terms

By creating an account, submitting a booking request, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy and Cookie Policy.

Organizations that register to use the Platform agree to these Terms on behalf of themselves and authorize their administrators and members to use the Platform subject to these Terms.

3. Description of Service

Gurughar360.ca provides a semi-managed community booking and event-management platform designed for Gurudwaras and Sikh community organizations. The Platform enables:

Community members to submit booking and event requests to their Organization.
Organization administrators to review, approve, and schedule events and resource bookings.
Community calendars to be maintained and communicated to members.
Administrative tools including reporting, sewa management, and user administration.

The Platform is a facilitation tool only. Gurughar360.ca does not manage, operate, or control any Gurudwara or Organization, and is not a party to any arrangement between an Organization and its members or volunteers.

4. "As-Is" Service

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, Gurughar360.ca expressly disclaims all warranties, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, and non-infringement.
Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Warranties regarding the accuracy, completeness, timeliness, or reliability of any information or content on the Platform.
Implied warranties arising from course of dealing or usage of trade.

You use the Platform entirely at your own risk. Gurughar360.ca makes no guarantee that the Platform will meet your requirements or that any particular results will be achieved through its use.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

5.1 Exclusion of Consequential Damages. In no event shall Gurughar360.ca, nor any of its directors, shareholders, officers, employees, contractors, agents, licensors, or service providers, be liable to any person or entity for any:

Indirect, incidental, special, consequential, punitive, or exemplary damages;
Loss of profits, revenue, data, goodwill, or anticipated savings;
Damages arising from loss of business, loss of opportunity, or reputational harm;
Any other indirect or implied losses of any nature;

whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, even if Gurughar360.ca has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

5.2 Cap on Direct Liability. To the extent that any direct liability cannot be excluded under applicable law, the total aggregate liability of Gurughar360.ca to any User or Organization for all claims arising out of or in connection with the Platform shall not exceed the greater of: (a) the total fees paid by the Organization to Gurughar360.ca in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred Canadian dollars (CAD $100.00).

5.3 Essential Basis. The parties acknowledge that these limitations of liability are an essential element of the basis of the bargain between Gurughar360.ca and Users. Without these limitations, Gurughar360.ca would not be able to provide the Service at the pricing offered.

5.4 No Liability for Third Parties. Gurughar360.ca is not responsible for the acts or omissions of any Organization, administrator, or user of the Platform, including but not limited to event decisions, booking approvals or rejections, resource allocation, or community governance matters.

5.5 Third-Party Infrastructure Providers. The Platform is built on standard, commercially available infrastructure and services provided by third parties, including but not limited to Google LLC (authentication, analytics), Microsoft Corporation (cloud infrastructure), Heroku (Salesforce) (application hosting), Brevo SAS (transactional email), and MongoDB, Inc. (database services). Gurughar360.ca relies on these providers' own security, availability, and data-protection measures and does not independently warrant or guarantee their performance.

Gurughar360.ca shall not be liable — directly, indirectly, or by implication — for any loss, damage, data breach, service interruption, or harm of any kind arising out of or in connection with the acts, omissions, outages, security incidents, policy changes, or practices of any such third-party provider, whether or not Gurughar360.ca had prior notice of the possibility of such loss. Users and Organizations acknowledge that use of the Platform inherently involves reliance on these third-party services and accept the associated risks.

6. Indemnification

You agree to indemnify, defend, and hold harmless Gurughar360.ca and its directors, shareholders, officers, employees, and agents from and against any claims, actions, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or inability to use the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your violation of any rights of another party.

7. User Responsibilities

Users agree to:

Provide accurate and complete information when registering and submitting requests.
Use the Platform only for its intended community booking and scheduling purposes.
Not use the Platform in any manner that is unlawful, harmful, or disruptive to others.
Not attempt to gain unauthorized access to any portion of the Platform or its infrastructure.
Comply with all applicable laws and the rules and policies of their Organization.

8. Organization Responsibilities

Organizations that use the Platform are responsible for:

Ensuring their administrators use the Platform in compliance with these Terms.
Managing member access and permissions appropriately.
The accuracy of all data entered into the Platform on behalf of the Organization.
Complying with applicable privacy laws with respect to their members' personal information.
All decisions made using the Platform, including event approvals, scheduling, and resource allocation.

9. Intellectual Property

The Platform and its underlying software, design, trademarks, and content (excluding data owned by Organizations) are the intellectual property of Gurughar360.ca and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited right to use it as described herein.

10. Service Availability and Modifications

Gurughar360.ca reserves the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time with or without notice. We will endeavour to provide reasonable advance notice of significant changes. Gurughar360.ca shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Termination

Either party may terminate the use of the Platform at any time. Gurughar360.ca reserves the right to suspend or terminate access for any User or Organization that violates these Terms or engages in conduct that is harmful to the Platform, other users, or the community.

Upon termination, Organization data will be handled in accordance with the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Platform shall be resolved by negotiation in good faith. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in Alberta, Canada.

13. Entire Agreement and Severability

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gurughar360.ca regarding your use of the Platform and supersede all prior agreements and understandings. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to These Terms

We reserve the right to update these Terms at any time. We will update the "Last updated" date above and, for material changes, provide notice through the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
